DMCA Copyright Policy

Kuldari respects the intellectual property rights of others and expects users of our platform to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA) and other applicable intellectual property laws.

Reporting Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on our platform, please notify our designated copyright agent with the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity, including information reasonably sufficient to permit us to locate the material
  • Your contact information, including your address, telephone number, and email address
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with our copyright agent. Your counter-notification must include:

  • Your physical or electronic signature
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the courts in your location and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person

Repeat Infringer Policy

Kuldari maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of copyright. We may also, at our sole discretion, limit access to our platform and terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Processing of Notices

Upon receipt of a valid DMCA notice, we will:

  • Remove or disable access to the allegedly infringing material
  • Notify the user who posted the material that we have removed or disabled access to the material
  • Provide the user with a copy of the DMCA notice
  • Take reasonable steps to notify the user of their right to file a counter-notification

If we receive a valid counter-notification, we will forward it to the original complainant. If the complainant does not notify us within ten business days that they have filed a court action to restrain the allegedly infringing activity, we may restore the removed material or cease disabling access to it.

False Claims

Please be aware that under applicable law, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability.

Educational Use and Fair Use

As an educational platform, Kuldari recognizes that certain uses of copyrighted material may constitute fair use under copyright law. We consider fair use claims on a case-by-case basis. However, users are responsible for ensuring that their use of copyrighted material complies with applicable copyright laws.

Limitations

Modifications

We reserve the right to modify this DMCA policy at any time. Changes will be effective immediately upon posting to our platform. Your continued use of our platform following the posting of changes constitutes your acceptance of such changes.
